Terms and Conditions

Definitions

The Applicant - The applicant outlined on the booking form.

The Company - Unity Sailing LLP, trading as Unity Sailing, a limited liability partnership registered in England and Wales (number OC440837), registered office 66 Broadlands Way, Rushmere St Andrew, Ipswich, Suffolk IP4 5SU; sailing from Mercury Yacht Harbour, Southampton, SO31 4HQ.

The Owner - The owner or operator of the Vessel named on the booking confirmation. Where the Vessel is owned or operated by the Company, the Company is the Owner.

The Vessel - The yacht named on the booking confirmation.

Force Majeure - In this Agreement 'force majeure' means any cause directly attributable to acts, events, non-happenings, omissions, accidents or Acts of God beyond the reasonable control of the Company, the Owner or the Applicant (including, but not limited to, strikes, lock-outs or other labour disputes, civil commotion, riots, blockade, invasion, war, fire, explosion, sabotage, storm, epidemic, collision, fog, governmental act or regulation, major mechanical or electrical breakdown beyond the crew's control).

Appointed Skipper - The professional coach or skipper engaged for the Vessel: certified and commercially endorsed, with all in-date certifications, and engaged by the Owner or by the Company on the Owner's behalf.

About Unity Sailing

The Company is a booking agent. It brings together yacht owners, professional coaches and crew: it matches each Vessel with a professional coach or skipper, organises the sailing programme, and takes bookings for places aboard.

Who your booking is with

Your place aboard is provided by the Owner of the Vessel named on your booking confirmation, sailing with the Appointed Skipper engaged for the Vessel.

Unless the booking confirmation names the Company as the Owner, the Company acts as booking agent for the Owner. The contract for the sailing (your place aboard, the Vessel and the Appointed Skipper) is between you and the Owner. The Company arranges the booking, engages the Appointed Skipper where the Owner asks it to, takes payments on the Owner's behalf and passes them to the Owner, less the Company's commission. The commission is paid by the Owner and is not an extra charge to you.

The Company's commission is agreed with each Owner. In support of empowering everyone through opportunity, the Company offers reduced or 0% commission on certain initiatives and events, including:

  • WOKC (Women's Open Keel Boat)
  • The Magenta Project
  • The Griffin Project
  • Youth programmes which support mental health

Where the Company provides something itself (its own vessel, coaching booked on its own, or kit and merchandise), the Company supplies it to you directly.

Agreement

Payment

The Applicant shall pay the deposit and all balances due by the dates outlined in the booking form, to the Company, which receives them on the Owner's behalf. The deposit is a part-payment for the booking.

Late payments may be subject to an additional admin fee of £50, at the discretion of the Company.

Where a security deposit is required (for example, for a whole-boat charter), the Company holds it on the Owner's behalf and returns it after the booking, less the cost of any damage under Accidental Damage Payments.

Accidental Damage Payments

In the case of any damage or losses caused by the Applicant to the Vessel or her equipment due to an act of negligence, the Applicant will be liable to the Owner for the value of those losses or damages up to a maximum of £1,000. The Company may collect this on the Owner's behalf, including from any security deposit.

Cancellations or Amendments to Booking

The Company handles cancellations, rescheduling and refunds on the Owner's behalf.

The Applicant shall have the right to cancel in writing their booking no less than 30 days prior to the booking date. All payments paid will be held and can be allocated to a new booking.

The Applicant shall have the right to reschedule their booking no less than 30 days prior to the booking date. Any deposit paid will be used against the new booking.

The Applicant shall forfeit all payments made if cancellation is made within 30 days of the booking date.

In the event the Company or the Owner needs to reschedule the booking for reasons other than Force Majeure, every effort will be made to move the booking date. If a mutually agreed date cannot be found within 12 months of the booking date, the balances paid shall be refunded.

In the event of severe weather or the decision of the Appointed Skipper to make necessary changes to the training plan, onboard training will be provided as an alternative.

Obligations

The Owner shall provide the Vessel, along with an Appointed Skipper responsible for the Vessel and all crew/applicants aboard for the duration of the booking.

The Company shall arrange the booking, provide the joining information and handle payments as set out above.

Neither the Owner nor the Company shall be liable for any loss or cancellations necessary before or during the booking period as a result of any acts outlined as Force Majeure.

Insurance and Liabilities

The Owner warrants that the Vessel and all her equipment shall be insured for the duration of the booking or charter.

Our quality guarantee. The Company only works with yachts that are managed to a high standard and legally set up for commercial use. The Owner warrants that the Vessel is professionally coded to MCA standards for up to Category 2 and meets World Sailing Offshore Special Regulations (OSR) Category 2 for offshore racing, and will keep it so for every booking.

The Owner is responsible for the Vessel, the Appointed Skipper and the Vessel's safe operation. The Company is responsible for arranging the booking correctly.

Neither the Owner nor the Company excludes liability for death or injury caused by its own negligence or wilful default.

The Applicant shall be responsible for their own personal insurance to cover personal accident, medical, and emergency expenses, loss of baggage or personal effects, money, cancellations and travel disruptions.
